My boss wanted to change the old 4010 phones to the new 8029.
The distributor says that you need to upgrade to R12.0. The cost of upgrading 20,000 usd is very expensive.

8029 - you need OXE R10.1.1 (j2.603.29b) and upper

Because you have old type phones (4010) - your system old enough. When system was upgraded to R10 - I think was 1 year SPS contract (and was possibilities to upgrade your system during this year to the new releases).

Just change 4010 type to 4029, buy 8029 and connect them .
I have a customer with R10.0-j1.410-49 who is using 8039 as 4039 at his own risk - he has been told about that. No problem noticed so far.
Actually when you configure 80x9 set the choice is 40x9/80x9.
